- Please note: All bidders and others attending any auction agree that they have read and fully understand these terms and agree to be bound thereby.
- Identification - All purchasers are required to have a Bidder's Number to bid - registering by full name and address and other information deemed necessary.
- Show your number to the Clerk after each purchase to eliminate possible error.
- Dispute between bidders - If any dispute arises between two or more bidders the decision of the auctioneer shall be final and absolute.
- Reserve - The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer shall have the right to bid on behalf of the seller. Generally, unless announced, there are no reserves.
- As Is - Each item is sold "as is", no guarantees or warranties either expressed, or implied, unless announced from the block. Look before you buy.
- Responsibility - Purchaser(s) assumes complete responsibility for the items at time the Auctioneer says "Sold".
- Payment - Complete payment in full required auction date - nothing to be removed from premises before settlement. Title passes when purchaser's funds clear through banks. Same day removal is necessary.
- Claims - No claims will be allowed after goods are removed from premises.
- Records - The record of sale kept by the Auctioneer and Clerk will be taken as final in the event of any dispute.
- Personal and Property Risk - Persons attending during exhibition, sale or removal of goods assume all risks of damage of, or loss to, personal property and specifically releases the auctioneer from liability therefore. Neither the auctioneer nor his principal shall be liable by reason for a defect in, or condition of, the premises on which the sale is held.
- Agency - The Auctioneer is acting as agent only, and is not responsible for acts of its principals. The contract seller of any and all goods is always the client of the auction company. We always reserve the right to protect the interest of our sellers.
Absolutely no collusion or bid rigging permitted. Any hint of any bidders attempting to stifle or influence the bidding process will result in the immediate removal of person or persons from the premises. No absentee bids will be accepted.
Auctioneer reserves the right to refuse to register any prospective bidder for any reason, and to require the removal of any person from the auction site for any reason including, but not limited to: (1) tampering with auction lots; (2) any illegal conduct including collusive bidding or stealing; (3) disruptive behavior; (4) failure to abide by these terms; and (5) intoxication. Bidder agrees to leave the auction site immediately and quietly upon request by Auctioneer. Any act of theft, vandalism, collusive bidding, or disruption will be prosecuted to the fullest extent of the law.
Bid Rigging is s very serious federal crime. Auctioneer will immediately report illegal conduct by any person to the United States Attorney and Department of Justice for Investigation and prosecution to the fullest extent to the law. Title 15, Section 1 of the United States Code provides any agreement among potential bidders not to bid against one another, or otherwise to dampen the bidding process, is a felony under federal law. The law provides the fines of up to $10 million per violation for a corporate offender, and $350,000 per violation for others, as well as imprisonment of up to three years. DON'T TAKE THE CHANCE!
